Scribblenauts developer 5th Cell and publisher Warner Bros. are named in a trademark infringement suit for the series' inclusion of Nyan Cat and Keyboard Cat, according to a complaint recently filed by the memes' respective creators. Charles Schmidt, who uploaded Keyboard Cat's breakout performance to YouTube in 2007, and Christopher Orlando Torres, who made the quickly viral Nyan Cat animated GIF, jointly filed a copyright and trademark infringement suit against the two companies. Both felines can be conjured up in-game using protagonist Max's magic notebook, but their cameos were not cleared with Schmidt or Torres, the suit claims. The Windows PC version of Scribblenauts Unlimited, 5th Cell Media's sandbox puzzle game, is on sale at Amazon for $8.99 for a limited time, according to the game's Amazon listing. The sale will last through next Wednesday, April 17, and offers a discount of 70 percent off of Scribblenauts Unlimited, which retails for $29.99. The game requires Valve's Steam client to activate. On Windows PC, Scribblenauts Unlimited uses Steam Workshop to share players' in-game creations. The game is also on sale on Steam for $10.19, a savings of 66 percent. The European release of Scribblenauts Unlimited is being delayed, Nintendo confirmed in a note issued today. Despite initial plans to launch the Wii U and Nintendo 3DS title on Feb. 8, Nintendo now states changes to the game must be made before Scribblenauts Unlimited is eventually released. The publisher did not specify what these changes might be. "We are sorry to announce that Scribblenauts Unlimited, a game developed by Warner Bros. Interactive and 5th Cell and published by Nintendo of Europe for both Nintendo 3DS and Wii U, will be delayed in Europe," reads the statement. Scribblenauts Unlimited is scheduled to hit the Wii U in Europe on Feb. 8, it was announced on today's Nintendo Direct conference. The game will now be published by Nintendo, it was revealed. Last month developer 5th Cell confirmed the game's delay throughout Europe. Scribblenauts Unlimited is currently available in North America on Nintendo 3DS, Wii U and PC. Unlimited was initially planned as a launch title for Wii U in Europe. It remains unclear why the title was delayed.

The European release of Scribblenauts Unlimited is delayed until 2013, developer 5th Cell confirmed to Twitter. Despite being currently available in North America on Nintendo 3DS, Wii U and PC, the fourth title in the Scribblenauts series will release next year in Europe. While it has been suggested this could be due to localization issues, one developer for the studio told NeoGAF forum users this was not the case. "It's due to stuff I can't talk about until 2013," they said. "Scribblenauts and Super Scribblenauts were released NA and EU the same day. Trust me. I want your money. GameStop is "bullish" on the upcoming Wii U launch, with high demand for both hardware and software exhibited by strong pre-order numbers, said GameStop executives on an investor call today for the retail giant's third-quarter financial report. The company is now reporting that "nearly 500,000" people have joined its wait list for Wii U consoles. GameStop set up the wait list in late September exclusively for PowerUp Rewards members, and as of mid-October, more than 250,000 customers had joined the list. Pre-orders for Scribblenauts Unlimited on Steam will unlock a Scribblenauts-themed hat called the Cockfighter in Team Fortress 2, according to the game's listing on Steam. The TF2 hat is fashioned after the hat that Maxwell wears in the Scribblenauts games, and the game's official Twitter account showed the pre-order bonus in action earlier today with a tweet linking to the pic above. The game is set for release Nov. 20. on Steam for $29.99. Scribblenauts Unlimited will also release in time for the Wii U's launch this weekend with in-game Nintendo characters. Nintendo's Wii U will not have a universal achievement system across all its games akin to the Xbox 360's Achievements system or the PlayStation 3's Trophy system, the creative director and co-founder of Scribblenauts development studio 5TH Cell said in a post on NeoGaf. Posting to the popular video game message board, Jeremiah Slaczka said that the Wii U does not have system-wide accomplishments. Rather, it is up to the developers to decide whether they wish to implement their own system. "Scribblenauts Unlimited loosely has them in the form of 'Global Starite Shards' which is like a giant checklist of global things to spawn and do in the game that aren't area specific," he said.
